Decision
Having heard the submissions of the parties, the Board orders as follows:
The Board directs that, due to the pendency of related criminal proceedings, the hearing dates previously scheduled in this matter be adjourned.
A Notice of Hearing setting forth new hearing dates will be issued.
The Union has agreed to provide to the Employer an OHIP consent form duly signed and executed by the Grievor (in a form provided to the Union) within two weeks after this issuance of this Decision.
The Union has agreed to provide to the Employer a consent form signed/executed by the Grievor (in the form provided to the Union) relating to his family physician Dr. C. Breyan, within two weeks after the issuance of this Decision.
The Union has agreed to provide to the Employer a consent form signed by the Grievor (in the form provided to the Union) relating to his chiropractor Dr. Paul Vagners, within two weeks after the issuance of this Decision.
The Employer has agreed to provide to the Union a full and unedited copy of the Preliminary Review Report and the Report of the Investigation into Allegations of Resident Abuse by Jan Dupuis, including witness statements.
The Employer has agreed to provide to the Union the information in its possession regarding details of and the treatment of injuries to Residents 1 and 2.
The documents and information described above are to used solely for the purposes of this litigation and may not otherwise be shared or distributed.
