HEARING

November 7, 2006.

This matter came before me on November 7, 2006. The parties agreed to this matter being scheduled at the June 14, 2006 file meeting. On June 21, 2006 the Grievance Settlement Board (“GSB”) notified the parties of the hearing date.
On November 7, 2006, I attended at the GSB to convene the hearing of this matter. The employer was in attendance however the union was not. Counsel for the employer represented that she had been in contact with the union had discussed this matter. I find the union had actual knowledge of the hearing date.
I waited the normal thirty-minute grace period. At the end of that period I re-convened the matter. The union was still not in attendance. The employer requested that I dismiss the matter and award costs in their favour.
I direct the registrar to reschedule this matter. On the next day of the hearing in this matter, I direct the union to show cause why this matter ought not be dismissed.
I am seized.
