HEARING
June 16, 2006.
Decision
Mr. Clark grieved on September 23, 2005 that he had been wrongly denied compassionate leave and was required to use a vacation day. The parties referred this grievance to mediation/arbitration in accordance with Article 22.16 of the Collective Agreement.
At the outset of the hearing the parties agreed that I had the jurisdiction to deal with these matters and they asked that I issue a decision without written reasons.
Having carefully considered the submissions of the parties, as well as the jurisprudence of the Board, I hereby order the Employer to reimburse the Grievor’s vacation bank with one day.
