HEARING
March 30, 2006.
Decision
On August 7, 2003 Mr. Jeff Jaques grieved that it had recently been brought to his attention that “on Sunday, June 30, 2002 I was not offered an overtime shift despite being on the overtime list …” He alleged further that this violated the local overtime policy and further that he was not offered a “pre-booking shift as were others …”
The parties referred this grievance to mediation/arbitration in accordance with article 22.16 of the collective agreement.
At the outset of the hearing, the parties agreed that I had the jurisdiction to deal with this matter and they asked that I issue a decision, without written reasons.
Having carefully considered the submissions of the parties, as well as the jurisprudence of the board, I find that there is no merit to the grievance and it is therefore hereby dismissed.
