HEARING
March 16, 2006.
Decision
There were and continue to be a number of procedural issues which remain unresolved between the parties. At the hearing, however, I directed that the parties continue to abide by the terms of a protocol to which they had previously agreed. The union is to seek to secure certain documents and to provide copies of any such arguably relevant documents to the employer. The union has agreed to do so as soon as possible but, in any event, will make its best efforts to insure the process is complete not later than April 30, 2006. Once the employer has been advised of and provided with the results of that process, it will indicate, within 30 days, what, if any, production issues remain outstanding. The parties will contact the Board shortly to establish a date for a hearing or conference call to deal with any such issues.
Dated at Toronto this 21st day of March 2006.
