Decision
This case deals with the grievor’s termination, which was effective July 23, 2004.
The parties agreed that this matter was to be dealt with under the mediation/arbitration procedure set out in Art. 22.16 of the collective agreement. The parties also requested that I issue an order with respect to the case without reasons.
After reviewing the evidence and submissions, I provided an oral ruling at the hearing on March 24, 2005 ordering that the grievor was to be reinstated effective July 23, 2004, and this decision confirms that oral ruling.
After I provided my oral ruling, the parties held discussions and reached an agreement with respect to all outstanding matters, which is set out in a separate memorandum of agreement dated March 24, 2005.
