HEARING

February 5, 2004.

Decision

The grievors were designated to provide emergency services during the 2002 work stoppage in the Ontario public service. Based upon the letters designating them as emergency workers, they claim standby pay for time not actually worked during the strike. This issue posed by these grievances is identical to that decided in OPSEU and Management Board Secretariat, GSB No. 2002-2427, decision dated January 26, 2004 (Brown). For the reasons set out in that decision, the grievances are dismissed.

The parties agree that this decision applies to any similar grievance, not yet before this board, claiming standby pay for time during the strike.
