HEARING

March 23, 2004.

Decision

The Parties referred these grievances to mediation/arbitration in accordance with Article 22.16 of the Collective Agreement. These grievances involve the grievor’s job specification and a job competition at the Central East Correctional Centre.

At the outset of the hearing, the parties agreed that I have jurisdiction to decide this matter, and requested a decision without reasons.

Having carefully reviewed the submissions of the Parties, I order that the grievor shall be assigned to the Administrative Assistant OAG 8 position effective immediately. Further, should a vacancy occur for the Personnel Clerk, OAG 9 position within the following twelve (12) months from the date of this decision, the grievor shall be appointed to the position.

Accordingly, the aforementioned grievances are resolved.
