Decision
A hearing was held on May 10, 2004 by conference call with regard to a request by the union that the employer produce certain documents in advance of the hearing scheduled before this Board on June 24, 2004.
Having regard to the positions taken by the parties, it is hereby ordered as follows:
The employer shall produce to the union forthwith, the following:
(1) Copies of all notes made during the investigation conducted by the employer which resulted in the disciplining of the grievor, including in particular notes of interviews conducted with the grievor’s co-workers.
(2) Any documentation containing conclusions made by the employer.
(3) Names of all employees of the employer who were interviewed.
(4) A copy of a note allegedly left on the complainant’s locker on or about January 15, 2004.
(5) Any other material in the investigation file that has not been disclosed to the union todate.
The information contained in the documents produced pursuant to this order shall be treated with confidentiality, and shall only be used for purposes of this proceeding.
