Decision
This grievor failed to appear at the hearing scheduled into this matter.
Some time after the scheduled start time of the hearing the parties ascertained that the grievor was at work. While it might have been possible to further delay the start of the hearing to facilitate the grievor’s arrival from Hamilton, the parties agreed that would have been an inefficient use of their time. The parties then agreed to adjourn the matter and new hearing dates have now been set for October 29, 2004 and November 8 and 9, 2004 at the Grievance Settlement Board offices in Toronto..
These new hearing dates, however, will be peremptory on the grievor. Should he again fail to appear, I will entertain any motion the employer may wish to make to have the grievance(s) in this matter dismissed.
