CONFERENCE CALL
November 4, 2004.
Decision
During a conference call on November 4, 2004, counsel for the Employer requested an adjournment of a hearing scheduled for November 18, 2004. A hearing was scheduled for November 18, 2004 to address a grievance of Wayne Miller, a meat inspector. The grievance raises issues concerning the Employer’s implementation of a Memorandum of Settlement entered into by the parties in November 2003. In making the adjournment request, counsel noted some difficulties in the receipt of the notice of proceeding and the fact that her advisor is unable to attend the hearing on November 18, 2004. Counsel for the Union opposed the adjournment request.
Having regard to the circumstances, I find it appropriate to adjourn the hearing scheduled for November 18, 2004. After discussing an alternative date with counsel, the hearing will now take place on November 26, 2004. The Registrar will send the parties a notice of hearing in due course.
Dated at Toronto, this 5th day of November, 2004.
