HEARING
January 9, 2004.
DECISION
The union and the employer have both agreed that, in the circumstances of these grievances and, in particular, considering the relief being sought by the union, Mr. Keating is entitled to fully participate in these proceedings.
Although several hearing days have already been devoted to the case, we have yet to hear any viva voce evidence. At the last day of hearing, Mr. Keating, for the first time, was represented. His counsel sought the adjournment of the proceedings on that day and on a number of the future dates scheduled prior to his retainer. Over the objection of the union, I granted the request in respect of the January 9, 2004 hearing date. In addition, the parties were able to agree to adjourn the hearing scheduled for March 25, 2004. No such agreement was possible with respect to the hearing dates scheduled for April 22 and 23, 2004. I am not prepared to adjourn those dates which have been set for some time.
Accordingly, while the immediate request was granted, the request to adjourn the April dates is denied.
This hearing is currently scheduled to continue on February 18; March 24; April 22, 23 and 27; May 28; June 25, 28 and 29; and September 13 and 14, 2004.
