HEARING

October 5, 2004.

ORDER

1. The hearing in this matter was to continue on October 4, 2004 and October 5, 2004. Due to the unavailability of the grievor, and the failure of the grievor to provide full particulars, the hearing could not proceed as scheduled.

2. The hearing will now continue on June 27 and June 28, 2005 as well as September 14 and September 15, 2005. At that time, the grievor and the Union will be expected to proceed with their evidence.

3. Prior to that time, specifically on or before April 29, 2005, the grievor and the Union must provide counsel for the Employer, Mr. Kearny, with the particulars and documents set out in Mr. Kearny’s letter of June 23, 2004.

4. If compliance with this Order is not forthcoming by April 29, 2005, the Board will consider a motion by the Employer to dismiss these grievances.
