ORDER
The following disclosure order is made, without prejudice to any arguments the Union may raise in terms of additional disclosure:
The Employer is to provide to counsel for the Union the grievors’ e-mail accounts which were reviewed by the investigator(s).
The Employer is to provide counsel for the Union with a list, showing the name, position, branch, division, director, the investigation phase, recommended discipline and final discipline of all OPSEU members disciplined as a result of the investigation involved in this matter.
The Employer is to provide counsel for the Union with a list, showing the branch, division, director, investigation phase, recommended discipline and final discipline for all non-OPSEU employees disciplined as a result of the investigation, as well as their status (i.e., management-exempt, AMAPCEO-exempt, etc.)
All of this disclosure is solely for the purpose of this litigation and is only to be used for the purpose of this litigation.
