HEARING

DECISION
The parties referred this grievance to mediation/ arbitration in accordance with Article 22.16 of the Collective Agreement. The grievance involves the issue of seniority calculations while the grievor was employed with the Ministry of Community and Social Services.
During the course of the mediation, the parties were unable to fully resolve the outstanding issues and agreed that I should decide the case on the basis of the information presented to me during the course of that mediation. They further agreed, in the interests of expedition, that I need not set out the reasons for my ruling in the matter.
On the basis of the information before me and having considered the submissions of the parties, I am satisfied that the grievor has entitlement to a further 75 weeks of seniority. The employer is hereby directed to amend the employment record accordingly, including retroactive vacation entitlement adjustments from July 24, 1996, if applicable.
I shall remain seized should the Parties encounter any difficulties arising in the implementation of this order.
