HEARING

May 15, 2003.

DECISION

The Parties referred this grievance regarding the conversion for a Social Worker II position at the Cecil Facer Youth Centre to mediation/arbitration in accordance with Article 22.16 of the Collective Agreement.

At the outset of the hearing, the Parties agreed that I exercise my jurisdiction to decide this matter.

Having carefully reviewed the evidence presented and the submissions of the Parties, I hereby order that the grievor be converted to the Classified position of Social Worker II at the Cecil Facer Youth Centre effective May 12, 2003. The Employer shall continue to provide and fund additional French language training for the grievor.

The Grievor shall continue to take training to improve her French language skills consistent with the requirements of the position to which she has been assigned.

I shall remain seised should the Parties encounter any difficulties arising in the implementation of this order.

Accordingly, the aforementioned grievance is resolved.
