HEARING
March 24, 2003.
Decision
The parties referred the above-captioned job competition/discrimination grievances to mediation/arbitration in accordance with Article 22.11 and Appendix 2 of the Collective Agreement.
At the outset of the hearing, the parties agreed that I had jurisdiction to deal with this matter and they requested that I issue a “without precedent” decision with no reasons.
Having carefully reviewed the submissions of the parties, the grievances are allowed to the extent outlined below:
The employer is directed to appoint the Grievor to the position of “C” Store Manager, Store # 302, Mount Forest, effective June 2, 2003. In this regard, the employer shall pay the grievor at the 2nd step of the salary and classification schedule for “C” Store Managers which is $24.13/hour;
This decision hereby resolves all outstanding claims, grievances or actions the grievor may have against the employer with respect to the events and circumstances giving rise to the above captioned grievances; and
In the event that the parties have any difficulties implementing this decision, I shall remain seized.
