HEARING
May 23, 2003.
Decision
The Parties referred this grievance regarding Article 44.10 at the Toronto Jail to mediation/arbitration in accordance with Article 22.16 of the Collective Agreement.
At the outset of the hearing, the Parties agreed that I had the jurisdiction to deal with this matter and they requested that I issue a without prejudice decision, with no reasons.
Having carefully reviewed the submissions of the Parties I hereby direct the Employer to provide evidence of full repayment to the grievor for all affected shifts, in accordance with the jurisprudence of the Grievance Settlement Board. Accordingly the aforementioned grievance is resolved.
I shall remain seised of this matter should the Parties encounter any difficulties.
