HEARING December 19, 2000.
Decision
The Parties referred this matter to mediation/arbitration in accordance with Article 22.16 of the Collective Agreement. At the outset of the hearing, the Parties agreed that I had the jurisdiction to deal with this matter and requested that my decision be on a without prejudice and expeditious basis.
In his grievance dated August 5, 1997, the grievor, a Probation Officer in the Ministry of Correctional Services, alleged that the Employer violated Article 20.7 of the collective agreement.
Having carefully reviewed the evidence, the submissions of the Parties, and the written materials submitted by the grievor, I find that there has been no violation of the collective agreement. In reaching this decision, I have assumed that all of the information provided by the Union and the grievor is entirely accurate.
Accordingly, the grievance is dismissed.
