HEARING September 8, 2000.
SUPPLEMENTAL AWARD
In accordance with my initial Award issued February 15, 2000 in this matter, I order the following compensation to be paid to the grievor, Joseph Massa, less statutory deductions required by law:
$75,156.41, representing 23 months pay, one month’s salary for every year of the grievor’s seniority.
$9,800.00, representing lost overtime.
$6,012.00, termination pay under the Employment Standards Act.
$17,457.00, severance pay under the Employment Standards Act.
$11,273.46, representing 15% of salary in lieu of benefits.
$ 1444.50, for the voided 10-day suspension.
minus $3036.00 for the 30-day suspension imposed.
$ 5375.00 income tax gross-up, based on half of the amount due being paid forthwith as set out in Paragraph 9 below, with the remainder to be paid on January 2, 2001.
The Employer is to pay the first half promptly upon receiving direction from the grievor, through his counsel, about RRSP allocations, and direction by Human Resources Development Canada about required deductions under the Employment Insurance Act.
I shall remain seized.
