Under section 283 of the Insurance Act, R.S.O. 1990 c. I.8 as it read immediately before being amended by Schedule 3 to the Fighting Fraud and Reducing Automobile Insurance Rates Act, 2014, and Regulation 664, R.R.O. 1990, as amended, it is ordered that:

1. The request for appeal expenses is dismissed.

REASONS FOR DECISION

I. NATURE OF THE PROCEEDING

This matter involves the SABS–1996.¹

This is a request for appeal expenses arising from my decision issued March 21, 2018.

II. BACKGROUND AND ANALYSIS

In a decision issued March 21, 2018, I dismissed an appeal brought by Sherese Peters (“the Appellant”). Unifund Insurance Company (“Unifund”) then requested an assessment of expenses for that appeal.

On April 10, 2108, I wrote to the parties and directed them to file written submissions in regard to appeal expenses and to send them to me no later than May 14, 2018.

Neither party provided me with submissions in regard to expenses of the appeal proceeding.

Accordingly, I am dismissing the request for an assessment, and making no award of expenses in this matter.
