Issues:
The Applicant, Harmeet Singh, was injured in a motor vehicle accident on October 3, 2006. In a decision dated April 10, 2012, I dismissed his claim for housekeeping expenses and awarded expenses of the proceeding to State Farm.
The issue in this further hearing is:
- What is the amount of expenses Mr. Singh should pay State Farm?
Result:
- Mr. Singh shall pay State Farm expenses of $1,740.01.
EVIDENCE AND ANALYSIS:
Mr. Singh did not appear at the pre-hearing of this matter. His counsel represented him by telephone. The substantive issue identified at the pre-hearing was a claim for about $4,000 in housekeeping expenses plus interest. The preliminary issue was whether the claim was barred by the expiration of the two-year limitation period set out in the Schedule. I dealt with the matter by written submissions. Mr. Singh did not make any submissions. I dismissed his claim for housekeeping expenses on the basis that it was out of time and awarded expenses to State Farm.
State Farm’s counsel submitted a Bill of Costs outlining 19.34 hours at the applicable legal aid rate of $89.79 per hour together with $7.06 for disbursements. The Commission received a facsimile transmission from Mr. Singh’s counsel on May 18, 2012 indicating that she will see Mr. Singh shortly regarding these circumstances. I received no further submissions.
I find the amount claimed reasonable.

Under section 282 of the Insurance Act, R.S.O. 1990, c.I.8, as amended, it is ordered that:
- Mr. Singh shall pay State Farm Mutual Automobile Insurance Company $1,740.01 as expenses of the arbitration proceeding.
