Issues:
The Applicant, Bismark Asamane, claims to have been injured in a motor vehicle accident on June 2, 2004. He applied for and received statutory accident benefits from TD General Insurance Company (“TD General”), payable under the Schedule.1 The parties were unable to resolve their disputes through mediation, and Mr. Asamane applied for arbitration at the Financial Services Commission of Ontario under the *Insurance Act*, R.S.O. 1990, c.I.8, as amended.
At the outset of the hearing respecting this and two other related matters counsel for Mr. Asamane advised that he did not wish to proceed with the arbitration and the parties were agreed to an Order dismissing the arbitration with the parties bearing their own expenses.
An Oral order to that effect, confirmed in writing herein, was made at the hearing.
