DECISION CORRECTION
On October 20, 1999, I issued a decision in the above matter. On page 17, top paragraph, I found that Ms. Kaur was entitled to a death benefit in the amount of $10,250.46 under subsection 51(5) of the Schedule as a result of her son Tajinder's death. This amount also appears in paragraph 2 of the Arbitration Order, following the decision.
The amount set out above is in error. The accident in question occurred in 1994, and the proper amount payable under subsection 51(5) of Ontario Regulation 776/93, the Schedule in force at that time, is $10,000. Accordingly, the top paragraph on page 17 of the decision should now read:
Consequently, Ms. Kaur is entitled to a death benefit of $10,000 under subsection 51(5), in addition to the amount she is entitled to receive under subsection 51(2) as a result of Shelley's death.
Paragraph #2 of the Arbitration Order should now read:
- Ms. Kaur is entitled to a death benefit under subsection 51(5) of the Schedule as a result of Tajinder's death in the amount of $10,000.
