On October 5, 1999, I issued a decision in this matter. The Order omitted an issue of expense entitlement. Item 4 has been added to the Amended Order as follows:
Under section 282 of the Insurance Act, R.S.O. 1990, c. I.8, as amended, it is ordered that:
The law firm of Azevedo & Associates is removed as solicitors of record for Mr. Da Silva.
Mr. Da Silva's claim for accident benefits is dismissed.
Kingsway is entitled to its assessment fee of $3,000 plus disbursements totalling $878.
Kingsway is entitled to expenses of $750, pursuant to the Order of Arbitrator Blackman, dated August 5, 1999.
