AMENDED ARBITRATION ORDER

On October 18, 1999, I issued a decision in this matter. The Order contains a typographical error. Paragraphs 1 and 2 of the Order are amended by substituting further statutory accident benefits for future statutory accident benefits. The amended Order reads as follows:

Under section 282 of the Insurance Act, R.S.O. 1990, c.I.8, as amended, it is ordered that:

1. The exclusion endorsement has no effect on the claims of Satinderpaul Singh for further statutory accident benefits.

2. General Accident is not required to pay Gurpal Singh further income replacement benefits as a result of the motor vehicle accident of April 13, 1995.

3. General Accident is not estopped from relying on the excluded driver endorsement with respect to that accident.

4. Mr. and Mrs. Singh's expenses of this hearing are in the discretion of the hearing arbitrator.
