OVERVIEW
1This decision sets out the reasons for the Fire Safety Commission (“Commission”) deciding to confirm two Inspections Orders made by the respondent, the London Fire Department, further to the appellant’s appeal under s. 26 of the Fire Protection and Prevention Act, 1997 (“FPPA”).
2The Inspection Orders related to two properties located at 3 and 11 Buchanan Courtin London, Ontario (the “Properties”). The Properties are both single-storey industrial F2 medium hazard occupancies. The buildings are attached to each other by an aboveground tunnel-like structure and both 3 and 11 Buchanan Court are utilized to store combustible products on racking.
3The respondent attended the Properties on January 29, 2026, and issued the Inspection Orders to require remedying contraventions of the Fire Code O. Reg. 213/07, made under the FPPA, as amended as of January 1, 2026 (“Fire Code”). The Commission notes that the respondent’s Inspection Orders reference 3.3.2.2.(3) from the version prior to 2026 and the amended version 3.2.2.2.(3) of the Fire Code will be referenced throughout this decision.
4On February 12, 2026, the appellant requested a review of the Inspection Orders by the Fire Marshal finding contraventions of sentence 3.2.2.2(3) of the Fire Code, pursuant to section 25 of the FPPA. On February 12, 2026, the Fire Marshal issued two Fire Marshal Reviews and Orders: FM-25-0061(11 Buchanan Court) and FM-25-0055 (3 Buchanan Court), collectively referred to as the Review Orders, confirming Item 1 of the Inspection Orders and amending the compliance dates for both to May 12, 2026.
