ORDER
The Court of the Drainage Referee fixed this date for a case management conference to address the following:
(a) to give directions for the giving of notice to those who may be affected by the result of this application and establish a process for giving them an opportunity to participate as a party;
(b) to hear preliminary motions; and
(c) to deal with such other matters or things as may arise and which the presiding Referee may determine is expedient to permit.
and, after hearing from counsel that the application by Barbara Spence is to be dismissed without costs, and that the application of Foreman Investments Inc. is to be dismissed, but that the issue of costs in this application is yet to be decided; and having since been advised that the agreement as to costs in the application of Foreman Investments Inc. is that Foreman Investments Inc. is to pay the Municipality costs fixed in the amount of $2,500.00
THIS COURT ORDERS that
The Barbara Spence application, Court of the Drainage Referee File No.: CV-24-00000018-0000 (Walkerton), on consent, is dismissed without costs.
The Foreman Investments Inc. application, Court of the Drainage Referee File No.: CV-24-00000019-0000 (Walkerton), on consent, is dismissed with costs fixed in the amount of $2,500.00 payable by Foreman Investments Inc. to the respondent Municipality.
