ENDORSEMENT
1The motion for leave to appeal the decision of Lavine J. dated May 22, 2024 is granted on the issue of whether Her Honour erred in ordering, as a term of the dismissal of a motion for a Mareva injunction, that the Moving Parties pay into court to the credit of this action the net proceeds of sale of certain defined lands.
2Costs of the motion for leave to appeal are reserved to the panel that hears the appeal and are fixed at $5,000 all-inclusive.
