REASONS FOR DECISION
D.L. Corbett J. (Orally):
[1] This is an appeal as of right to the Divisional Court from the judgment of a Superior Court judge pursuant to the Construction Act, being the order of Centa J., dismissing Mr. Baradaran’s motion opposing confirmation of the Construction Lien Report of Associate Justice Robinson.
[2] The motion before Centa J. was in the nature of an appeal from the Associate Justice. Before us, Mr. Baradaran essentially repeats the submissions he made to Centa J. and submits to us that Centa J. erred in his findings – thus this is essentially a second round of appeal.
[3] We agree with Centa J. and we see no need to supplement his decision. The appeal is dismissed for the reasons given by Centa J.
[4] The appellant shall pay costs of the appeal to the respondent fixed at $10,000.00, inclusive, payable forthwith.
