ENDORSEMENT SUPPLEMENTARY TO REASONS ON APPEAL

[1] Since issuing its decision, the court has learned that counsel for the Respondent has fallen ill and will be unable to comply with the deadline set for serving and filing the amended pleading as directed by the court in paragraph 59 of its reasons. The Appellants have conveyed their position that the deadline ought to be extended in the circumstances. As well, the Appellants ask that, in the circumstances, the requirement for the Respondent’s approval as to form and content of their proposed draft order be dispensed with so that they may comply with the time limits for seeking leave to appeal the decision of this court. That is reasonable in the circumstances.
[2] There shall be an order to go that the Respondent shall serve and file the amended pleading by January 31, 2024; the Appellants shall serve and filed their amended defence 20 days hence. The Appellants may proceed to take out their proposed draft order without the approval as to form and content of the Respondent.
