[1] The motion for leave to appeal the order of Akbarali J., dated May 24, 2023 (unreported), is granted, with costs of $5,000 payable in the discretion of the appeal panel.

[2] The orders in SCJ File CV-23-00698472 as amended by the Divisional Court order in this case, dated July 7, 2023, shall remain in effect subject as follows: para. 3 of the order of Centa J. dated June 3, 2023, and para. (i) of the order of Akbarali J. dated May 24, 2023, are amended to read as follows: “This order will cease to have effect if the defendant provides security by paying the sum of the Canadian dollar equivalent of € 3,266,122.45 into court, and the Accountant of the Superior Court of Justice is hereby directed to accept such payment.”
