2The amount sought by the respondent of $35,000 on a substantial indemnity basis, and approximately $25,000 on a partial indemnity basis, is far in excess of what is normally awarded by this court in these kinds of cases.
3We award costs payable by the applicant to the respondent in the amount of $10,000 all inclusive
