2The appellant advised the respondent by email earlier this year that she does not intend to pursue this appeal. She confirmed this position today.
3On consent the appeal is dismissed. The respondent asked for costs. While I accept that some time was involved in bringing this before the court, the appeal was never perfected and the respondent never filed a factum or responding materials. There shall be no order for costs.
