Reasons for Judgment
[1] Constab International Inc. successfully sued Vladimir Pak in the Small Claims Court. Mr. Pak appealed and a single judge of the Divisional Court dismissed his appeal. Mr. and Mrs. Pak maintain that, when they attended at the Court of Appeal to file an appeal from that decision they were told that the proper forum is a three-judge panel of the Divisional Court. Mr. and Mrs. Pak also maintain that they were given similar advice by the Divisional Court office. If this occurred, it is regrettable.
[2] The Divisional Court still has no jurisdiction to hear this appeal and it is quashed. Mr. and Mrs. Pak should attend at the Court of Appeal office in Osgoode Hall if they wish to pursue the appeal.
[3] There will be no order concerning costs.
[4] The order required by this endorsement shall be prepared by the respondents and forwarded to me for approval, and afterwards a copy of the order shall be emailed to Mr. Pak.
