COSTS ENDORSEMENT

[1] Success was divided on the appeal. The Respondent was substantially successful on the appeal relating to Attorney and Estate Trustee compensation; whereas the Appellant was successful on the costs appeal in that she was relieved of personal exposure of approximately $45,000 in costs. Thus, there will be no costs of the appeal.

[2] However, given the Appellant’s Offer to Settle the issue of costs of the appeal on the same basis as we have found, we are of the view that she should have modest costs of $1,500, all inclusive, for the trouble and expense of having to make written costs submissions. Such costs are payable by the Respondent within 30 days.
