[1] The following sets out our disposition of the costs of this appeal which was dismissed by our judgment given orally at the conclusion of the hearing.
[2] The respondent seeks costs of $10,000 fixed on a partial indemnity basis. The appellant submits that there should be no award of costs against him but that costs of $1,300 should be awarded against the respondent in his favour.
[3] There is no reason why we should depart from the general rule that costs should follow the event.
[4] The hearing of this appeal consumed one full day. As well, the appellant earlier brought two interlocutory motions before a single judge of this Court. Both motions were dismissed and costs were referred to this panel.
[5] The respondent’s preparations for this appeal were clearly extensive and its counsel’s submissions were focused and helpful to us. The latter cannot be said about the appellant.
[6] We are satisfied that the amount sought by the respondent is fair and reasonable and was within the reasonable contemplation of the parties.
[7] Accordingly, the respondent is entitled to costs, fixed at $10,000. The appellant is not entitled to any costs.
