Supplementary ENDORSEMENT re: costs

[1] In my reasons for decision, released November 20, 2012, I invited written submissions on costs.

[2] Ms. Mitchell, the respondent on this appeal, is entitled to a cost award as the appellants appeal was dismissed. Ms. Mitchell and Mr. Aragao, counsel for the appellant, have presented correspondence indicating their agreement on a cost award fixed in the amount of $500. This amount essentially reimburses Ms. Mitchell for her out of pocket expenses of attending court and serving dockets. The amount agreed to is certainly reasonable.

[3] Accordingly, the joint request is approved. Ms. Mitchell is awarded costs, payable by 2156645 Ontario Inc., fixed in the amount of $500.
