Supplementary ENDORSEMENT re: costs

1In my reasons for decision, released November 20, 2012, I invited written submissions on costs.

2Ms. Mitchell, the respondent on this appeal, is entitled to a cost award as the appellants appeal was dismissed. Ms. Mitchell and Mr. Aragao, counsel for the appellant, have presented correspondence indicating their agreement on a cost award fixed in the amount of $500. This amount essentially reimburses Ms. Mitchell for her out of pocket expenses of attending court and serving dockets. The amount agreed to is certainly reasonable.

3Accordingly, the joint request is approved. Ms. Mitchell is awarded costs, payable by 2156645 Ontario Inc., fixed in the amount of $500.
