[1] This is an application for leave to appeal to the Divisional Court, a decision of Perell J. certifying a class and issues for determination, pursuant to the Class Proceedings Act. Leave to appeal is addressed in s.62.02 of the Rules of Practice and the appellant is afforded two grounds upon which to seek leave, each with sub-requirements that raised the bar to be overcome at an even higher level.
[2] Leave will be granted where there is a conflicting decision by another judge or a court in Ontario or elsewhere on the matter and it is in the opinion of the judge hearing the motion desirable that leave be granted, or there appears good reason to doubt the correctness of the order in question and the proposed appeal involves matters of such importance that leave should be granted.
[3] Although I am indebted to counsel for their comprehensive review of the applicable law upon the four criteria that the applicant insists apply and have been established in order to succeed upon this application, I am not persuaded that there are conflicting decisions and/or that there is reason to doubt the correctness of the decision of the motions judge.
[4] As such, this application is dismissed with costs to the plaintiff/respondent in the amount agreed upon by the parties at the commencement of the hearing.
