COSTS ENDORSEMENT
[1] The successful plaintiff seeks costs of this appeal in the sum of $5,428.74, all-inclusive.
[2] The defendant acknowledges that the plaintiff is entitled to costs but submits that those costs be fixed at $3,500.00, all-inclusive.
[3] We are satisfied that the plaintiff’s claim is substantially justified by the time spent, the result achieved and the responsibility undertaken by counsel. Accordingly, we award costs to the respondent, rounded off to $5,400.00, all-inclusive. We consider that this award is fair and reasonable and within the reasonable expectation of the parties.
