[1] The parties were given until January 26, 2011 to file written submissions on costs. Mr. Shuter met that deadline, but Ms. Ford has not filed any submissions. It is now two months past the deadline and she is out of time.
[2] Mr. Shuter’s submissions are not entirely clear and are somewhat convoluted. Nevertheless it appears that he claims approximately $5,000 for transcripts and approximately $900 for the cost of copying exhibits.
[3] No invoices were submitted for the cost of copying exhibits. The same is true for the transcripts, but the transcripts expense appears to be accurately calculated in accordance with the rules.
[4] In all of the circumstances, including the circumstances revealed in the judgment of the court released January 10, 2011, we fix the costs payable by Ms. Ford to Mr. Shuter at the sum of $2,500 all-inclusive, payable upon the settlement of all claims between the parties or the conclusion of the trial.
