LEDERMAN J. (ORALLY)
[1] In a letter dated March 12, 2010, the court reporter confirmed that the transcript was completed on February 22, 2010 but has not been picked up or paid for by the appellant. Ferrier J. ordered, among other things, that the appeal is to be perfected on or before February 22, 2010 and that date was peremptory.
[2] The appellant has not complied with that order. Pursuant to the order of Dambrot J. the respondents now move ex parte for an order dismissing the appeal as Ferrier J.’s order has not been complied with. It is appropriate to grant the order. The order dismissing the appeal is hereby granted.
