[1] On June 10, 2008, the Presiding Member of the Social Benefits Tribunal, Patrick Doran, noted that the issue had been resolved. The Case Presenting Officer apologized for any inconvenience this may have caused to Mr. Direk. Because the matter of an overpayment of $234.64 had been resolved, there was nothing for the Tribunal to decide and so it issued a "no order." As the Tribunal has made no decision, therefore, pursuant to section 21(1) and 31(1) of the Ontario Disability Support Program Act, there is nothing to appeal to the Divisional Court of Ontario. There is no question of law listed in the notice of appeal, and nowhere in that notice is there any indication of a problem with respect to the "no order."
[2] The appeal from the Tribunal's "no order" is therefore quashed as disclosing no reasonable basis for appeal. Likewise, the appellant's allegations of a "Gross Chain Conspiracy, Canadian Judiciary-Driven Systematic-Crime, and (Justice)-Officials part of the Conspiratorially-Tainted Immorally-Driven Canadian Justice-Line" are also dismissed as disclosing no reasonable basis for appeal.
[3] If requested by the moving party, the responding party will pay nominal costs of $50 to the moving party in the name of the Director of the Ontario Disability Support Program (which is the proper name of the moving party).
