[1] The applicant requests an adjournment on the grounds that her health issues have not permitted her to prepare. This is her third adjournment request for health reasons.
[2] The respondent has been put to expense and has been delayed.
[3] The applicant has filed a medical report which has been blacked-out in parts and is therefore of uncertain value.
[4] Matter adjourned with costs thrown away fixed at $500.00, payable within 30 days to the respondent, failing which the application shall be dismissed.
[5] Hearing date set for August 17, 2009, peremptory to applicant. If she cannot present her case on her own, she must retain counsel.
[6] Motion for leave to appeal No. DC-08-00000317-00ML adjourned to panel to be heard following this judicial review application.
[7] Given that both matters arise out of the same decision of the Tribunal, it is appropriate that they be heard together.
