ENDORSEMENT

[1] The request for a stay pending appeal is dismissed. At my request this motion proceeded based upon written submissions. The respondent is unrepresented, resides in India, and wished to make her submission with respect to the stay motion by way of video teleconferencing. In the circumstances I refused the request for oral submissions.

[2] I have carefully read the appellant’s material. I do not agree with the arguments made. The appellant has not complied with the order of Justice Backhouse. Subject to compliance, the appeal should be expedited.
