Re: Singh v. Workplace Safety and Insurance Appeals Tribunal
Before: Lane*, Kiteley and Swinton JJ.
Counsel: Ravinder Sawhney for Mr. Singh Brad Elberg for the Tribunal
Heard at Toronto: By written submissions
COSTS ENDORSEMENT
[1] The respondent Workplace Safety and Insurance Appeals Tribunal seeks costs of $2,000.00 for this application. The applicant submits that no costs should be awarded because of his financial circumstances.
[2] The Tribunal was successful on this application, and costs normally follow the event. While the bill of costs sets out $17,663.11 in total fees, disbursements and taxes, the Tribunal seeks $2,000.00. That is a fair and reasonable amount in the circumstances of this application. Therefore, costs are awarded to the respondent in the amount of $2,000.00, inclusive of GST and disbursements.
