[1] The appellant has moved to introduce fresh evidence on the appeal. The motion is denied.
[2] The evidence consists of three affidavits of Ms. Goyette, obviously prepared to comply with Perell J.’s Order.
[3] The appellant submits the affidavit support the submission that Perell J. should have ordered the trial of an issue. We disagree. These affidavits were not before Perell J. and cannot now be used to support the submission that he should have ordered the trial of an issue.
