Jaan Lilles, for the Respondent
HEARD at Toronto: November 21, 2007
swinton J.: (Orally)
1The appellant has brought a motion to consolidate the hearing of the motion to set aside the order of Cumming J., dated February 16, 2007, with a motion to set aside the order of Lane J. made May 1, 2003, dismissing her application for judicial review as premature.
2The appellant had ample time to bring the 2003 motion on for hearing in a timely manner and she has not done so. The motion with respect to the order of Cumming J. is a discrete matter.
3Therefore, the motion to consolidate is dismissed, and we will proceed to hear the motion respecting the order of Cumming J. which is, as I have said, a discrete matter.
