COSTS ENDORSEMENT
[1] UA Local 787 and Teamsters Local Union 419 seek costs of the application for judicial review. UA seeks $7,500.00 for the application and the motion to introduce fresh evidence, while the Teamsters seek $5,000.00. The Ontario Labour Relations Board does not seek costs. The applicant submits that no costs should be awarded.
[2] In our view, costs should follow the event despite the applicant’s submission that the payment of costs would cause him serious hardship.
[3] UA, the applicant’s former employer, was required to participate fully in this application and motion to adduce fresh evidence because of the applicant’s allegations of misconduct on the part of the Local and its business manager. Both UA and the Teamsters faced difficulties in responding to the applicant’s materials.
[4] Taking into consideration what would be a fair and reasonable amount that the losing party should pay, costs are awarded to the teamsters in the amount of $3500 and to UA Local 787 in the amount of $5,000.
