A. SUBMISSIONS OF COLLEGE COUNSEL
3College Counsel sought the Panel’s permission to withdraw the allegations set out in the Notice of Hearing for the following reasons. First, the Member’s Certificate of Qualification and Registration has already been revoked on October 28, 2019. Second, the complainant no longer wished to participate in the hearing given that 5 years has passed since the date of the incidents and that the Member’s Certificate of Qualification and Registration has already been revoked. It would not be in the public interest to proceed in the circumstances.
B. SUBMISSIONS OF MEMBER’S COUNSEL
4Member’s Counsel accepted College Counsel’s submissions.
C. DECISION
5On March 25, 2021, upon hearing the submissions of the parties and given the consent of the parties, the Panel authorized the College to withdraw the allegations against the Member set out in the Notice of Hearing dated September 10, 2019.
D. REASONS FOR DECISION
6The Panel has jurisdiction to make the order requested pursuant to Rule 13.13 of the Rules of Procedure of the Discipline Committee and of the Fitness to Practise Committee. The Panel accepts the submissions of College Counsel that it would not be in the public interest to proceed with this matter given that the Member’s Certificate of Qualification and Registration has already been revoked and the complainant no longer wished to participate in the hearing. The Panel finds that the withdrawal of the Notice of Hearing in these circumstances is reasonable and appropriate.
